Replying to an old post but - the garages contract with the insurer may change how they behave - but the OP had a contract with the Garage, not the insurer. And he was successful in going to court and getting a judgment against the garage, not the insurer. I was quite surprised it got this far, it seemed a clear cut case, usually these get mutually resolved in the days before the court date.
That's what I was saying - at least that's what I thought I was saying, but perhaps there was some ambiguity if you've posted that?

OP, my earlier question refers - I'm interested to understand a little more about the dynamic in terms of this getting to a hearing, as opposed to being settled, as on the face if it, it was a hopeless case.

Thank you all.

I looked up on line how to pursue the matter having been advised by a legal pal that that would be next step.
Prior to issuing court papers I also tried Citizen’s Advice, then the Motor trader dispute resolution folk and finally motor ombudsman. This was when I received no response to letters etc.
All three recommended the court route.
The various court fees/hearing fees and most modest settlement fee were paid to me by the defendant the day after the hearing.
I’m under the impression that if that payment hadn’t been forthcoming a county court judgement would have been applied against Chippenham Motor Company / MRG or maybe their Director/Secretary etc

Thank you all for your interest and support.

We’re glad it’s all over and massively recommend Horton Cars (Oxfordshire/Bucks border)
