We have a court date set for mid May 2022.
Thank you all for your interest.
I aim to update you after the court hearing.
To be honest, I’m trying to put it out of my mind. Though not a ‘life and death’ situation, it has been very stressful to both me and my wife.

I wish you all the best in your court case, and fair play to you for standing up to them, I know it means even more stress than you have already had to endure, but you are doing what you think is right and any other sane person who has followed this story i'm sure will agree and hope justice prevails and you get the right outcome and also compensated for the many hours you have spent chasing a fair resolution, which if that dealer had any decency at all would have done the right and fair thing for you, and how many forum members have read these posts and thought to themselves - [especially if they are local to that main dealer] - well I won't be taking my car for a service there then. They have shot themselves in the foot.

The number of these engines (in various cars and vans) that were wrecked because folk don't know to read a manual (any belt kit that comes for your engine has a spec sheet in it!), re use of old bolts (there are places you can get away with this, and there are places you cannot!), folk who don't know how a torque wrench works etc*


*a local multi trade garage nearby, has a very good rep, I've used them and sent many that way. Have had lots of vw vans recently (with this engine) in for cambelt. Stopped by the other day and had to ask how they were doing it, as when I last spoke to them (previous year) they didn't own any 3/4" drive tools or a crank pulley counter hold. Said they had now stopped doing work onthat type of engine as "they always break a few weeks or months later, so we don't do them anymore".
Thats why. Because they are wrecking them through the negligence of reading a bit of paper. Dafties.

Default Court Follow up

Hi Stephen, (I have had to post a reply to you here)

Thank you for asking.

The court letter arrived yesterday (the hearing was last week)

1. Judgement for the Claimant
2. Defendant to pay: a. damages b. Interest thereon c. Fixed costs and Court fees.

Although the damages/interest were virtually negligible for the effort involved, I am just one of those folk who has to persue such 'injustices'!

The poor old Judge was not overwise and even more deaf than me ;-)

I had my day (well - afternoon) in court.

She told me that we'd been treated very badly.

On a very positive note, due to all of the hassle, I did a little research and have discovered Horton Cars HP18 9QQ Oxfordshire/Bucks. Graham and Charlie et al. (Volvo specialists)

They are proper mechanics with oily hands!!

They flushed the gearbox and serviced the Haldex 2 days ago.

For the tricky stuff I'll be heading back there in future.

Great to hear and we’ll deserved from the sounds of it! Do you now get a new engine, new vehicle, or just cash to make up for it all.

As everyone else.... I feel almost as delighted for you as you must be. Your persistence should never have needed to be tested in the first place, and it must have been more than tough to keep the effort up.

Your new car may never quite match the one destroyed by the garage, but yet it may be near enough.... Or maybe it does match up to what you have lost and deserve. Anyway, definitely a good result.

Well done to the OP for getting it sorted, hope you enjoy the XC70.

Replying to an old post but - the garages contract with the insurer may change how they behave - but the OP had a contract with the Garage, not the insurer. And he was successful in going to court and getting a judgment against the garage, not the insurer. I was quite surprised it got this far, it seemed a clear cut case, usually these get mutually resolved in the days before the court date.

Now the next part starts - he won't necessarily get his money straight away - they may pay up or they may be awkward. If it's the latter, the OP has to apply for a bailiffs warrant....
