Does that make a difference? Even I paid over the phone, but end of the day its a deal with a dealer so I would think it is similar to placing an order by going into the dealership?

Isn't it the same?

I am not sure and I am not suggesting it is the fair thing to do, it is when I read this article that made me think.

No, that is why the Volvo dealer in my earlier post wanted no money until I arrived on site a couple of days later.

Thanks. That's very helpful. I didn't know this.

I just read it and there is a catch..... see this

'What is important with regard to Distance or Off-Premises Selling is that the specific act of sale must be done at a distance. This means that you have to sign and return a vehicle order form, and have the dealer sign it and provide you with a copy, without you setting foot on their premises. Many dealers will try and avoid this by taking a deposit to “hold” the vehicle for you, or sign a draft contract “subject to viewing the vehicle”, and the final contract is only signed when you trek over to collect the car. The new contract supercedes the old, and vehicle is technically sold on the premises rather than at a distance. Dealers often use this technique to try and avoid their cancellation obligations under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, which replaced the old Distance Selling Regulations.'

so that's why these dealers ask you to come and collect the car, if they deliver at home then its more protection for customer.

I guess what you could do is thoroughly check and test drive the vehicle prior to signing or paying anything more.

Yeah, that's what I plan do. Keep enough time and not rush anything on that day

what is your situation?

I guess you also paid over the phone?

I paid a deposit over the phone and have not signed any paperwork. I did though visit the dealer to pick the car up for a day to try.

I am considering putting together a checklist of all the relevant issues being raised to check when I pick up the car. Does feel like I am having to be over cautious though.

Why not be cautious, that's a good point, I would try and do the same when I go to pick up.

After all that is the last and our best chance to get a prompt response for anything from the dealer (before we make the remaining deposit payment)

Default DEFCON 1 avoided

I've had a call from the dealer today and they've agreed to replace the car with a new one. I may have to wait until November for it as it'll be another factory order but meanwhile I can continue driving the current one.

Phew!

I have the option of choosing a different paint colour. My original choice was Savile Grey before I changed it to Bright Silver. I'm tempted to go back to Savile Grey especially having seen an XC90 in that colour at the dealer's today.
