I enclose a copy of Aviva’s letter dated the 14th November 2011 received yesterday. You will see that it appears from it that (although they did in June provide me with some albeit incomplete copies of personal information held about me) they have NOT been providing me with personal information about me, pursuant to my ongoing request, in that they are STILL not providing me with copies of the letters about me written to them by Mr R******’s claims company, nor are they providing me with copies of their own letters to Mr R*******’s claims company. I enclose a copy of Aviva’s letter dated the 14th November 2011 received yesterday. You will see that precisely as I predicted, and precisely as you denied would be the case, Aviva are, despite the express assurances previously given to me by them, are denying any obligation to defend me in court. Clearly this is likely to cause me financial loss. Moreover, you will see that it appears from that letter that (although Aviva did in June provide me with some albeit incomplete copies of personal information held about me) they have NOT been providing me with personal information about me, pursuant to my ongoing request, in that they are STILL not providing me with copies of the letters about me written to they by Mr R********’s claims company, nor are they providing me with copies of their own letters to Mr R*******’s claims company. As I told you I am still facing obstruction in discovering the case that Mr R****** (or his lawyers) is or are asserting, have not been shown what he or they have so far said or done, and have not been consulted about dealing with such case if any. Regrettably the conduct of Ms J******* at Aviva continues to fly in the face of your assurances. I enclose a copy of Aviva’s letter dated the 14th November 2011 received yesterday. Quite apart from the fact that much of it is largely unclear, it does reveal two major problems. You will see that precisely as I predicted Aviva are, despite the express assurances previously given to me by you, denying any obligation to defend me in court. I must urgently press you to re-confirm to me that Aviva WILL defend a court case if brought against me for Mr ******, and further to get similar confirmation to me from Ms J*****. Second, you will see that despite what you said about the continuing supply to me of information, and although your “Data Protection Team” did in June provide me with some albeit incomplete copies of personal information held about me, Aviva they have NOT been providing me with personal information about me, pursuant to my ongoing request, in that they are STILL not providing me with copies of the letters about me written to them by Mr R******’s claims company, nor are they providing me with copies of their own letters to Mr R******’s claims company nor did they provide me with the things you said they would. I also refer to the two emails of Ms Re***** dated the 20th June 2011 (copies also enclosed). Please confirm that you have referred this letter to your supervisor and that it has been discussed with Ms Re******. You will see that I was given two express assurances. First that you would defend any case brought against me for Mr R******. Second that I would receive copies of existing correspondence from and to those puffing Mr R******’s claim and that I would continue to receive the like. You now seem to give the lie to both. I must insist on the provision of the missing information and your assurance that you will defend any claim by Mr R***** in court (at least until you settle it, if you do, in accordance with your entitlement to the conduct of proceedings).
