I actually jinxed this as I was telling a colleague about it and arrived home later that day to find the new letter. I'm surprised they're still chasing me after 3 years, they must know they can't get anything but I'm happy for them to keep paying to post my fancy letters.
As I said to my colleague though, when they changed the law in October 2012, they made it easier for PPC's. They can now harass the Registered Keeper and don't have to go after the driver! |

I got one from SMart parking for overstaying in an ASDA
Followed the Money SUpermarket Advice, worked like a dream. No more letters or invoices, happy days. Always remember the advice someone gave me - if its council or police issued, then pay it, anything else, its not enforceable. And if the car park if a free one - then these companies have more chance of hell freezing over than proving a financial loss in court - which is why funnily enough - they never end up taking anyone to court. Glad I got hold of the "invoice" as the wife was sat with the phone and the credit card |

Hi, for a company to give you a parking notice or charge they must be regulated and registered with the BPA by law. Section 19.1 of the BPA rules are that driver are not allowed to be penalised and by law they are only allowed to charge you for potential loss of revenue and not a penny more. So if there lots of spaces free on this private car park or if the car park was very quiet they are only allowed by law to charge for the parking space for the time you stayed. Eg £2.50 or however much a ticket cost for the time you stayed. Stand by your guns if it goes to civil court they will not have a leg to stand on charging you almost £100. If it was town centre midday and the car park was busy then they have a better chance but they would need to justify by law how by you parking in the space you were has cost them almost £100 in lost revenue. Good luck.
